Privacy Claims and Queries
In keeping with the legal rules in force concerning data protection, Regulation (EU) 2016/769 of the European Parliament and of the Council of 27 April 2016 (GDPR), and the Spanish Organic Act on Personal Data Protection and the Guarantee of Digital Rights (LOPDGDD, 3/2018, dated 5 December), we inform you of the Personal Data Protection Policy inasmuch as it relates to the processing of personal data provided by users through channels belonging to the companies of the Adam Foods Group through the “Contact” forms on our websites, by phone or by postal mail.
PRIVACY AND PERSONAL DATA PROTECTION POLICY
The Adam Foods Group undertakes to follow the laws in force regarding personal data protection.
Adam Foods Group guarantees that it will treat personal data users may provide through this channel as confidential, as well as put appropriate physical, technical and organisational security measures in place to protect your personal data.
You guarantee and are liable for, in any case, the veracity, accuracy, validity and authenticity of the personal data provided and undertake to keep them duly updated.
1. JOINT CONTROLLERS IN PROCESSING YOUR PERSONAL DATA
For the purposes of Article 26 of the GDPR, when two or more companies in the same group jointly determine the purposes and means of processing, they shall be joint controllers.
In order to abide by the principle of transparency and the obligations of the controllers, in particular as regards the rights of the data subject, users are hereby informed of the essence of the joint controller arrangement. It is as follows:
- The joint controllers have signed an agreement on the joint controller arrangement which sets out the terms of the collaboration between the Companies of the Adam Foods Group vis-a-vis personal data processing to satisfy the purpose set out in Section 2 of this Privacy Policy.
- The operations and activities of personal data processing shall have the same purposes, legal bases and recipients in the case of each of the joint controller companies.
- All of the joint controller companies shall grant all data subjects the same rights regarding data privacy and protection.
- A centralised contact point is established for data subjects regarding the exercise of rights of data subjects, security breaches and compliance with this Policy.
- Any changes to the joint controller arrangement or any activity or operation of the processing of personal data will require the agreement of the Companies of the Adam Foods Group. Notice of any such change will be provided to users to the extent it affects the processing of their personal data.
2. JOINT CONTROLLERS
For the purposes of this Data Protection Policy, the controllers of personal data are all of the legal persons listed in ANNEX I: Companies of the Adam Foods Group and they act as joint controllers for the purposes of Managing enquiries and claims.

3. PURPOSE AND LEGAL BASIS OF PROCESSING YOUR PERSONAL DATA
The Adam Foods Group processes identifying data (name, ID number, age, address, telephone number, email address) and personal characteristic data (age) provided by users through the “Contact” form, over the phone or by postal mail. The purpose of processing is to manage and answer enquiries and claims received from users.
The legal basis for the processing of your data is the express consent that is requested from you.
Your personal data will not be provided to any entity, except when required to comply with a legal obligation applicable to the Data Processors. No international transfers of data are anticipated.
4. DATA RETENTION PERIOD
Your personal data will be stored as long as they are required to fulfil the purpose indicated, as well as, where applicable, you do not withdraw your consent, or until you exercise your rights of opposition or your right of deletion.
Once one of these circumstances applies, Adam Foods Group will keep your data duly frozen for the time necessary to fulfil the legal or regulatory obligations, during the pertinent prescription periods set out in law that, where applicable, are relevant or appropriate.
Once the respective retention period has lapsed, Adam Foods will delete the data as long as the data need not be retained for other purposes that must be fulfilled.
5. INTERNATIONAL TRANSFERS
The Adam Foods Group has no plans to transfer personal data internationally. That notwithstanding, in the event that an international transfer is required in the future, then appropriate guarantees will be put in place to comply with data protection regulations and guarantee the security of your personal data.
6. COMMUNICATION OF DATA
The Adam Foods Group will not communicate your data to third parties unless there is a legal authorisation or obligation to do so.
Likewise, to provide you with services, the Adam Foods Group uses service providers who may have access to your data and at all times will act on behalf of Adam Foods according to our instructions. At no time will these service providers have access to your data for their own purposes.
7. EXERCISING DATA PROTECTION RIGHTS
Data protection regulations grant you a series of rights regarding personal data processing that can be summarised as:
- Withdrawing consent: You may withdraw your consent at any time. However, doing so will not affect the lawfulness of processing based on consent prior to your withdrawal.
- Accessing your data: right of access and to be aware if we are processing your personal data, right to access your data and request information about how and why we are processing your data and, where applicable, request a copy of your data.
- Request the rectification or deletion of your data: right to rectify the personal data we may be processing and that you consider inaccurate, or even to request the deletion of such data when they are no longer necessary for the purposes they were collected for.
- Request the limitation of processing of your data: right to request that we limit the processing of your personal data. In this case, we inform you that we will freeze your data and continue to store it, and that we will only use it to bring and defend against claims, for the purposes for which you have granted your consent, or to honour legal and contractual responsibilities.
- Portability: You can obtain an electronic copy of the data that are being processed, as well as request that they be transmitted to another entity.
- Object to the processing of your data: under certain circumstances and for reasons related to your particular situation, you will have the right to object to the processing of your data. In that case, we will stop processing them unless it is necessary to do so for legitimate reasons or to defend against possible claims.
You may exercise your rights by sending a request to that effect to the following email address: info@adamfoods.es or by postal mail to Grupo ADAM FOODS, Travesera de Gracia, núm. 342, 08025 and putting the following reference information on the envelope: REF: DATOS PERSONALES ATENCIÓN AL CONSUMIDOR/PERSONAL DATA CUSTOMER SERVICE, and providing the details necessary to answer your request (namely the right you wish to exercise).
In the event we cannot identify you, we will request additional information to identify you.
If you believe there is an issue with the way the Adam Foods Group is processing your data, you may file a claim with the Spanish Data Protection Agency on its website: www.agpd.es.
6. MODIFICATIONS TO THE POLICY
We may modify this Privacy and Data Protection Policy at any time. Any change to the policy will be published on the website.
