Under the current regulations on data protection, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), Organic Law on Personal Data Protection and Digital Rights Guarantee (LOPDGDD, 3/2018 of 5 December), we inform you about the Personal Data Protection Policy regarding the processing of personal data provided by users of the websites of the companies within the Adam Foods Group through the “Contact” forms on our websites, by telephone, or by postal mail.

The Adam Foods Group is committed to complying with the current legislation on personal data protection.

The Adam Foods Group guarantees that it will treat the personal data provided by users of this portal confidentially and that it applies appropriate security measures, both physical, technical, and organizational, for the protection of their personal data.

You guarantee and are responsible, in any case, for the truthfulness, accuracy, validity, and authenticity of the personal data provided and undertake to keep them duly updated.

1. JOINT RESPONSIBILITY IN THE PROCESSING OF YOUR PERSONAL DATA

For the purposes of Article 26 of the GDPR, joint responsibility exists when two or more companies within the group jointly determine the purposes and means of the processing.

To comply with the transparency principle and the obligations of the data controllers, especially regarding the rights of data subjects, users are informed that the main implications of joint responsibility are as follows:

The joint controllers have signed an agreement on joint responsibility that establishes collaboration between the Adam Foods Group Companies in activities involving the processing of personal data to fulfill the purpose set out in section 2 of this Privacy Policy.
The operations and activities related to the processing of personal data will have the same purposes, legal basis, and recipients for each of the joint companies.
All joint companies will grant the same privacy and data protection rights to all data subjects.
A centralized contact point is established for the exercise of data subjects’ rights, security breaches, and compliance with this Policy.
Any change to the joint responsibility regime or any activity or operation related to the processing of personal data will require the agreement of the Adam Foods Group Companies and will be notified to users to the extent that it affects the processing of their personal data.

2. RESPONSIBLE PARTIES FOR THE PROCESSING

For the purposes of this Data Protection Policy, the data controllers are all the legal entities listed in ANNEX I: Adam Foods Group Companies, which act as joint controllers for the processing of Consultation and Complaint Management.

3. PURPOSE AND LEGITIMACY OF THE PROCESSING OF YOUR PERSONAL DATA

Adam Foods Group processes the identifying data (name, ID number, age, address, telephone number, email address) and personal characteristics data (age) provided by users through the “Contact” form, by telephone, or by postal mail, with the purpose of managing and responding to queries and complaints received from users.

The legitimacy for the processing of your data is the explicit consent that is requested from you.

4. DATA RETENTION PERIOD

Your personal data will not be transferred to any entity unless it is required to comply with any applicable legal obligations of the data controllers. No international transfers of personal data are foreseen.

Your personal data will be retained as long as they are necessary for the specified purposes, and, where applicable, until you withdraw your consent or exercise your rights of objection or deletion. Once any of these circumstances occur, Adam Foods Group will keep your data duly blocked for the time necessary to comply with legal or regulatory obligations, during the applicable statute of limitations periods established by the legislation that, if applicable, may apply.

After the respective retention period, Adam Foods Group will delete the data unless they need to be kept for other legitimate purposes.

Data protection regulations grant you certain rights concerning the processing of personal data, which can be summarized as follows:

Withdrawal of consent: You can withdraw your consent at any time, but this will not affect the lawfulness of processing based on consent before its withdrawal.
Access to your data: You have the right to access and know if we are processing your personal data, to access them, and to request information about how and why we are processing them, and, if applicable, to request a copy of this information.
Request rectification or erasure of your data: You have the right to rectify any personal data that we are processing and that you consider inaccurate, or even to request the deletion of such data when they are no longer necessary for the purposes for which they were collected.
Request restriction of the processing of your data: You have the right to request the limitation of the processing of your personal data. In this case, we inform you that we will keep the data blocked and that we will only use them for the exercise and defense of claims, for the purposes for which you have given us your consent, or to comply with legal and contractual responsibilities.

6. CHANGES TO THE POLICY

We may modify this Privacy and Personal Data Protection Policy at any time. Any changes will be published on the website.
